GETTING MEDICAL RECORDS AIDS OR HIV INFORMATION |

Disclosure of AIDS testing information is governed by 381.004 Florida Statutes. This statute provides in part that both the identity of the person upon whom an AIDS test has been performed, and the results of such test are confidential. No person who has obtained or who has knowledge of a test result may be compelled to disclose the identity of any person upon whom a test is performed or the results of the test in a manner which permits identification of the patient except in certain narrow circumstances. This statute contains a lengthy list of very narrow situations when testing or test results may be disclosed. It is important to note that a general release of information is not sufficient to release AIDS information. It must be specific. To seek a court order for this information you must show a compelling need and the pleadings must use a pseudonym for the name of the patient.
